RE: Important Legal Notice Regarding Commission Junction’s Affiliate Network
If you joined or were a member of the affiliate marketing networks operated by ValueClick, Inc., Commission Junction, Inc. and/or Be Free (collectively, “Defendants”), between April 20, 2003 and the present, you may be a class member in Settlement Recovery Center et al. v. ValueClick, Inc. et al., No. 2:07-cv-02638-FMC-CTx, a lawsuit which is pending in the Central District of California. The Settlement Notice informs you of the Court’s certification of a class for settlement purposes; the nature of the claims alleged; your right to participate in, or exclude yourself from, the class; a proposed settlement; and how you can claim an award of advertising credits under the settlement or object to the settlement.
The proposed settlement will resolve claims that Defendants failed to adequately monitor Commission Junction’s Network for the use by third parties of software that does not comply with Commission Junction’s (“CJ”) Publisher Code of Conduct and that is intended to steal or divert commissions from publishers on CJ’s network (“Non-compliant Software”), failed to adequately monitor or prevent third parties from engaging in the theft or “hijacking” of commissions from Advertisers and Publishers on CJ’s Network, and failed to make sufficient disclosures regarding the existence of Non-compliant Software and commission theft, resulting in losses to both advertisers and publishers on the CJ Network.
The proposed settlement will provide a monetary recovery to eligible class members. For class members that currently maintain an account on the CJ Network will receive payment through payments or credits deposited or applied to their CJ accounts; eligible class members that no longer have accounts on the Commission Junction Network will receive a check for an equal amount.
If you are a member of the class, your legal rights are affected by whether you act or do not act. You should review the Settlement Notice as soon as possible as there are several important deadlines that you must meet to take certain actions in connection with this proposed settlement. In particular, the deadline for filing an objection or excluding yourself from the proposed settlement is September 30, 2008. For further information, please refer to the Settlement Notice.

YOU MAY BE ENTITLED TO BENEFITS UNDER THE TERMS OF THIS CLASS ACTION SETTLEMENT.

i have joined the commission junction on 28.02.07. but not operated till now. i have received the notice from settlement recovery centre. My account has been deactivated since i have not done any work. i would like send the message to settlement recovery centre v. ValueClick , settlement Administrator P.O. Box 3656 Portland, Oregon 97208-3656 USA, to exclude me from the class as my account has been deactivated and also i don/t want to continue further.

I got this postcard from Settlement Recovery Center too which I really don’t understand a lot about as I’m not so legal savvy but it said I had to respond to by Sept 30, 2008. I had once subscribe to what I think its an affiliate marketing company called ADNET MARKETING SOLUTIONS which I had called for months now and I have not been able to reach them as my account has been somewhat redundant since inception. Please i do need to know what to do. Is there someone who can please educate me a little bit about this? Please send your prompt responce to this email: geocraig2676@yahoo.com
What the hell is this. I too got this today. I was having little fever and this increased by temp but thanks to dp threads and later I found this post. I come to know that I’m not alone.

Can somebody please explain Settlement Recovery Center et al. v. ValueClick, Inc. et al., No. 2:07-cv-02638-FMC-CTx, in PLAIN ENGLISH rather than in legal jargon?
I signed up to Commission Junction a few years ago and still have ads running on my sites, but never seemed to get any commission.
Just tried to log in to CJ but none of my email addresses are recognised so I assume the account has been deactivated.
What are the implications if I exclude myself?
What are the implications if I DON’T exclude myself?
What am I objection to?

Hey friends, even I got this letter but am not understanding what exactly it is. I am not using this cj account n its not active also. Sending an exclusion letter through post will not go before 30th September. Then what have we to do now. Please somebody send me a mail at prititatuskar@yahoo.co.in

I paid a company, APEX Marketing Group, to connect me with several money making markets on line and APEX was suppose to monitor all the business. I paid $4500. for this and never received any thing for this. I have my email conservation inregards to this and the credit card dispute. Is this what this post card I received from Settlement Recovery Center is talking about? It says I have until Sept. 30, 2008 to respond. I am leaving for vacation tomorrow and will not be back until after Sept. 2, 2008.
